Brewery Beer Glass Shipping Laws

    Just wanted to vent a little about "Beer Laws". I live in Northern NJ where Sam Adam's Utopias is perfectly legal to purchase. So this year before the holidays I spotted a bottle of Utopias at a reasonable price in a local bottle shop. After purchasing it a buddy of mine from NYC mentioned it should have come with a coupon code for a free Utopias tasting glass. When I didn't see a coupon inside I decide to email Sam Adam's about my situation. This is the email I got back.

    Dear Scott,

    We’re glad you were able to find one of our Samuel Adams Utopias bottles, which can be very hard to find given it’s released in very limited batches. Where legal, some of our bottles include a hangtag to receive a special Utopias Reidel glass. Unfortunately, we are legally prohibited from shipping glasses to the following states: Alabama, California, Connecticut, Hawaii, Kentucky, Michigan, Mississippi, New Jersey, Ohio, Tennessee, Vermont, and Virginia. We make the beer, not the laws!

    I hope this helps and you enjoy your Sam Adams Utopia!

    I know it may not help, but that Utopias tastes great weather you drink it out of the special glass or your own glass.

    You can read my most recent version (I think it's about #3 or #4) of my rant about BBC, Utopias and their !@#$ "Free Glass" but, no, I don't blame the laws, I blame the Boston Beer Co. Walk into any New Jersey liquor store a month ago and there are tons of gift sets of beer, wine and spirits with free glasses - that is obviously legal in this state. For $200, BBC could have packaged the bottle with the free glass and not make customers jump through hops (oops... now why did I make that typo :grinning: ) hoops and even pay for !@#$ postage!

    They don't ship glassware to Cali ? I've seen a lot of SA glassware on sale at some of my bottle shops. That "Perfect pint" glass is everywhere

    I believe the law is something like they can't offer you free stuff with the purchase of alcohol. You can probably purchase the Utopias glass, or any other Sam Adams glass from their website. Definitely a dumb law either way though.

    That's odd that Michigan is on the list. Maybe it has to do with the "free" part of it? I've bought glasses direct from out of state breweries and had them shipped to me with no problems.

    Prohibition left overs, the bible, and just old thinking create some absurd laws that leave your scratching your head (or other end).

    Today there are over 20 breweries within a 10 mile radius of my house, yet I remember going to bootleggers with my dad growing up, as the area was stone cold dry, so off to bootleggers to buy anything (beer, wine, liquor including both bottled in bond and moonshine). It was not that long ago that the law was changed to allow beer over 6% ABV.

    My dad joked that when the sale of beer, wine and spirits was up for a vote, those protesting against it were the baptist preachers and the bootleggers.

    Liquor Laws are crazy, that's for sure.

    I know one where you can't discount/sell a 64oz. growler for too cheap of a price. So even if a place wanted to have $4 growler fills of their session blonde ale, they are legally disallowed from potentially losing money.

    There's some sort of "no giving away beer" for too little because of abv/ounce/serving size type of laws that make for many headaches of brewers

    This crap started with the free give aways from cigarettes. Some states enacted laws prohibiting marketing freebie incentives from buying cigarettes. ( Like the stuff you could get from buying Marlboro cigarettes. ) Then they included and alcohol products.

    I used to have my Utopias glass shipped to my mom in NC. Now they do not even include the coupon in the box if your state does not allow it.

    NC has its own share of "stupid laws" related to alcohol. Then combined with a new ALE agent in the area (NC Alcohol Law Enforcement) trying to make a name for herself, it has gone beyond absurd.

    Brewery fined because an employee after closing, doors locked, pulled a pint and drank it while doing his end of day tasks. ALE agents hiding across the street at 2:30AM and watching with binoculars... really, how petty.
    Every brewery sells clothing, t-shirts, hoodies, hats, etc. for a specific beer. An employee while working cannot wear any of this gear, but can wear something that isn't brew specific but can have the brewery name on it. I'm surprised they are allowed to tell you about a beer or make a recommendation.

    Beer festivals have been cancelled because of the overbearing ALE agency, just not worth the hassle. Oskar Blues ended up making their Burning Can beer festival free (refunding the $45 admission) as a measure to ALE from citing many of the breweries that came.

    In the state of NJ its all about incenting people to buy beer or not incenting them as the case may be. Of course we are well beyond prohibition in the state of NJ but incentives like a free glass or discount coupons are not allowed but if u package a product w/a glass its Ok and if u lower the price by 20% its OK but u can not offer it as a separate action or item. Does this make sense? Of course not but its a law and if u want to change a law it costs $$ and there needs to be a strong enough group that benefits enough to take it through the legal system and is willing to pay attorneys, lobbyists, etc…. My favorite odd law is in the state of Pennsylvania where sorority houses are not allowed on college campuses because the ancient law considers them brothels/houses of ill repute. Bunch of unrelated women living together in a single dwelling in 2016 are considered prostitutes by the great state of Pennsylvania - make sense? No but someone needs to pay to get it off the books….

    I could write a whole book of why Utah sucks relating ONLY to the beer laws. None of their laws makes sense. It's so bad, I don't have the heart to change my state profile to Utah even though I live there. Here's one example: ALL draft pours in Utah is 3.2% This limits the wide range of styles we could be drinking. Beer and politics do not mix.

    NJ ABC Handbook:

    The Boston Beer Co., distributing their products in all 50 states (and DC), is well aware that state laws differ and has grown to become the largest "craft" brewer in the country despite all those laws. While, apparently, there is some law that does not allow this free glass (I have received "free" material from countless breweries sent to a NJ address, including both a free hat [filled out a survey, IIRC] and free "Perfect Pint" glasses [as a Beer Advocate magazine subscriber] from the Boston Beer Co.) there is no reason that BBC should either make customers who bought a $200* bottle of beer (* if they're lucky and the retailer didn't mark it up beyond the MSRP) pay for shipping & handling :grimacing: OR not be able to get the glass due to state law.

    Package the glass with the bottle.

    Very interesting! I often bought glasses from Dogfish Head which was no problem shipping to NJ. Is there something we are missing here?
