Cease and desist order in FL

    Back in the day, when I lived in Memphis (some 30 years ago), it was not uncommon for people to drive over the bridge into W. Memphis Arkansas to obtain beer at the local Walgreens (it was right off the interstate, so very easy to get to). Prices were better than what you could find in Memphis, Tn, and the store carried a number of beers you couldn't find in Memphis Tn. The practice was prevalent enough that state Alcohol and Tobacco agents would sometimes park over in the Walgreen parking lot, waiting for folks to come out of the store with suspicious looking packages or bags. If they then hopped into their car (with a Tennessee license plate), and drove back over the bridge into Tennessee, the officers would often times pull them over to see if they were bringing untaxed alcohol into the state. I was clerking for a federal magistrate at the time, which is how I heard about this. My understanding was that in most instances the local judges concluded that the agents did not have "probable cause" to pull over and search the vehicles, and so most of the cases were thrown out. As I recall, it became such a public embarrassment for the agency, that they finally decided not to bother any more.

    The letter said they want me to continue to use them, just legally. So I'm not sure I'm flagged that I can't ship with them at all.

    This is bizarre for a few reasons. Did the letter come on proper letterhead, with recognizable contact info? Was it literally a cease and desist from their legal dept. or was it simply a form letter noting that it was against policy with no mention of legal ramifications?

    So not a true "cease and desist or we're taking you to court" letter, just a "stop sending exploding beer packages, man" letter. Doesn't sound like you have much to worry about. Ship beer via UPS for a while and you'll be fine.

    Just don't ship with fedex anymore. USPS is cheaper anyways

    It's also completely illegal.

    I'm not trying to be Mr. Law and Order (as I've shipped via USPS myself on occasion), but it sounds like the OP is trying to avoid doing something that he feels is blatantly illegal.

    I think everyone is just trying to be helpful. I know I go over the speed limit, don't always come to a complete stop and a myriad of other things. I'm not trying to be reckless but just be careful. I know it's not exactly the same thing but no one is this big kingpin trying to stick it to the government.

    Potato pic. I think its all legible if you squint lol. It was also dated but I removed it because

    As mentioned before the last thing in the world I need is to become a felon, I think that would speak for the majority of anyone. You mentioned speeding with ur car and not stopping at a stop sign but those don't even come close to a 3rd degree felony as stated in the FL statues of shipping alcohol illegally.

    It’s just a generic warning letter from FedEx letting you know your are violating their policy. I’d probably switch to another carrier for a while but if your really paranoid about shipping alcohol, just don’t ship alcohol :slight_smile:
