Based on what I tasted in Guns 'N' Rose, Oskar Blues might as well just drop it, but what do I know? Maybe it's a big seller? I can't imagine that it's a big enough seller to compete with legal fees though.

I'm surprised that this doesn’t happen even more often.

I'm also surprised that a simple C&D didn't get the job done. That's some arrogance coming from OB.

Should of just named it Axel Rose.

That seems pretty cut and dry, and I’m surprised a company the size of OB wouldn’t have known better or at least changed it once they got the letter. Perhaps they just really enjoy pissing away legal fees on a case they can’t possibly win.

I really enjoyed this beer but did actually wonder if this was going to lead to a lawsuit.

How funny, just was looking at this beer the other day and though man I cannot believe they are not being told to stop using the name, then wham this thread.

It is not a surprise in today's world.

Same here. For a short tic when I saw the can, I had an irresistible urge to sing Welcome to the Jungle. Lol.

I guess. Kinda seems like GnR should be grateful for anyone out there who's still willing to treat them as culturally relevant.

Anyway, I look forward to a disappointing resolution to this lawsuit roughly fifteen years from now.

I agree, anything that could result in some sales of their old records is a win in my book. Most people would just assume they are working with the brewery and its cool lol. Guess the lawyers want to get paid.

The band is looking for an easy buck. Haven't had the beer, but it has to be better than the band.

Take me down to Paradise City...

I have to disagree with some folks here and if you don't protect your brand who will? And if you don't where does it end?

And some cheap shots at the band, saw them in 2017, one of the best shows I have ever seen.

Bingo. Liked them in college (early 90s), but haven't thought about them in a long time. Seems like they would be happy for the nod and hope it might get some (relative) youngster to google them and download some tunes.

Uh, GnR's current tour landed them about a half billion dollars. Yes, that's billion with a B. I don't think they're doing this for the cash and they sure as hell don't need Oskar Blue's help. As a previous post suggested, you protect your trademark or eventually lose it. Shame on Oskar Blues for this.

I thought this was an obvious result, and I'm surprised it took even this long. They're not the only brewery doing this, either - lots of cheeky, fun, and pun-heavy labels at many different breweries reference established trademarks, from bands to movies and beyond.

I'm not a trademark lawyer, but I'm very surprised OB didn't just put up their hands, give their lamest "Aww, shucks, you got me," apology, and move on. Doubling down seems ... foolish.

This is not 1991....they just played 80 shows on their last tour and reportedly were on time for them all. I saw them in 2017 as well and they sounded great.

I think you guys are getting them confused with Motley Crew. You see, GNR actually played MUSIC. I mean they are in the rock n roll HOF. Which means that they will possibly be remembered forever, unlike OB lol

In 35 years of going to countless shows of the generations best, GnR was right at the top. They played 3+ hours, awesome. Appetite for Destruction one of the greatest albums of all time.

You still here? This is about how OB ignored a C&D and now this will cost them and their little CANarchy merger money. For being stupid. Maybe you should shit on them and not the band.

    Still here.

I like OB beer. Till the suit is over we won’t really know if they were being stupid. On the face of it sure it looks like a stupid move to not C/D. Pretty sure the lawyers for OB think they can win or they would not keep going on with the beer. Maybe OB knows the worst that can come of not C/D and are just pushing it to get the most mileage. Time will tell.

Still waiting to hear about the Stone v Stones suit.

As for my other point I will cease and desist.

    Enjoy

I actually think that brewers should get called out for this more often and that the beer industry will benefit as a result from "growing up."

The Brewer's Art eventually had to change this:

... and they deserved it. It looks as associated with an artist as this:
And the beer below (and others like it) are available in stores by me these days. I don't know if there's a story behind it, but it looks like a case of more of the same nonsense.

If used with permission? Fine, zero issues. Just piggybacking on someone else's work? Fuck that.

Uh, vamping on the name of a well established, decades old, popular, well selling, widely known artist isn't piggybacking?

    Fuck.

If GnR were so irrelevant, why did OB riff on their name? Why?

Because their "brand" (damn, I hate that term) has value, and OB wanted to capitalize on it.

Welcome to the Jungle of grown up business. OB is just prolly too baked to care. Let the accountants pay for it all.
