    Legal Ninja? Lawyer Ninja?


    I have some friends who run a ski company. They recieved a c&d letter from Scott skis because one of their skis was named the "Great Scott" after the owner of the company. They proceeded to change the name of the ski to the Cease and Desist. I wanna see something equally hilarious here.

    I think the lesson here is that it's possible to enforce TM rights without sending a C&D. The problem is that for some lawyers it's a lot easier to send a C&D than to pick up the phone and have a conversation. While that may be best for the lawyer, it may not be best for the client.

    I have q serious problem with the ninja series of beers that I think needs to addressed asap.

    Basically ninjas by nature CANNOT be seen. Please fix your labels.

    Tyranena has been around quite a bit longer, besides how hard hard is it to do some remedial market research to find out if the name is being used by another brewery? If you type "scurvy" to search for beer on this site the name comes up, not that difficult. A brewery has every right to protect the product of their image.

    Agree with this but I think Tyranena could've picked up the phone and said "it'd be cool if you used a different name" rather than having Lionel Hutz draft up a C&D.

    I dont think one person said they don't have a right to protect a trademark. There is a difference between what you can do by law, and what an ethical, responsible, rational person would do.

    Edit: seems like a good place for the freetail brewing cease and desist response

    True, but maybe they have plans to make it a regular production beer. I know some people will say big deal about using the name "Scurvy" but what if a brewery made a beer called "Darklord" or "Darkness", I bet they would get a C&D real quick. Personally, I am of the opinion that the onus is on the brewery releasing a new beer to verify that the name they choose isn't being used and if it is then change it or reach out to the brewery already using it.

    The beer was going to be called Scurvy Ninja, not just Scurvy. Should the Bruery get a C&D from Surly for their Tart of Darkness? Or any of these other breweries?

    In this case, there is a beer named "Scurvy" and a beer named "Scurvy Ninja." While I would agree that PW shouldn't use the name "Scurvy" on it's own, I personally believe "Scurvy Ninja" deviates enough so as to not cause confusion. In the case of your analogy, look at "Darkness." There are a number of beers that use the phrase "darkness" as part of their names such as "Heart of Darkness," "Army of Darkness," "Tart of Darkness," or even "The Darkness."

    That said, I've always been of the opinion this beer should have been called The Light That Spills Out Of The Hole In Your Ass, but, hey, that's just my sense of humor.

    Likely it is because they are both IPAs brewed with citrus. I still think it is inane.

    How about Tyranena Mex, with a picture of a T Rex, dressed as a ninja, wearing a sombrero, going to a hipster bar on Cinco de Mayo? Too much? Maybe add a lawyer pinata?
