Just wondering if there were any local bottle shares that are happening soon/scheduled? Would like to get in if so because I have a nice cellar full of beer that I wouldn't mind sharing, as well as try some new items
The ALE was cracking down kind of hard all around the city a few months back... So that's why they haven't been happening so much at businesses. I'd love to see bottle shares more often in Charlotte. It would be cool to find a venue where strangers can continue to do them without putting the businesses at risk.
Last year, OMB allowed people to share bottles prior to the release of their Fat Boy Baltic Porter. They'll be doing the same this year on Jan. 18. https://www.facebook.com/events/440235139410309/ There are a couple of groups of friends that do bottle shares from time to time, many of whom will be at OMB, I'm sure. Come on out!
From the ABC website: "Session Law 2013-392 - Effective December 1, 2013: As a general rule, citizens of legal age can "brown-bag" their own malt beverages and unfortified wine for their personal consumption almost anywhere in the state. This is now prohibited if the establishment's ABC permits are suspended." If I'm interpreting that correctly it means that you can take your own beer into any establishment with a valid on-premise consumption permit and as long as you have permission. Might have to bag the bottles but it should be perfectly legal.
Are we reading the same thing? I have had a few beers tonight, but I'm not seeing that.... I have shared several awesome bottles at a bottle shop (a bottle of Kate the Great being one of them) but felt I was breaking the law...lol... http://www.ncleg.net/EnactedLegislation/SessionLaws/PDF/2013-2014/SL2013-392.pdf
To the first post, I too have a nice stash...I have Dark Lord 2010, Darkness, Sexual Chocolate, AleSmith Old Numbskull, Deschutes Brewery Jubel 2010 (Once A Decade Ale), I'm open to a January share.....
Did they confirm the bottle share? I asked last week and they still hadn't made up their mind if they are doing the bottle share or not
I just read that law and it doesn't seem to state what you're saying. It seems that the law makes it illegal to consume alcohol at a business when that business has it's license revoked / suspended.
Yeah I should have linked to what I was looing at, which isn't the law itself but appears to be a memo issued by the ABC to clarify the law: http://reports.abc.nc.gov/uploads/resources/fbb4b88c121447e7a724ebafe1d9c37e.pdf I think the real issue here isn't that bottle shares are illegal per se, but rather that shop/bar owners don't want to risk getting in trouble for appearing to be stocking and/or serving beers which aren't legally distributed in the state.
Hmmm, interesting. I read the original law that it's an extension of as well and it seems to indicate that it's legal... http://www.ncleg.net/EnactedLegislation/Statutes/HTML/BySection/Chapter_18B/GS_18B-300.html (b) Consumption at Off-Premises Establishment. - It shall be unlawful to consume, or for a permittee to allow the consumption of, malt beverages or unfortified wine on any premises having only an off-premises permit for the kind of alcoholic beverage being consumed. So, a place like a bottle shop that also has a bar could hold a bottle share if they wish, since they also carry permits that allow consumption on-premises. On that note, maybe it does just come down to fear of the ALE accusing them of distributing / selling alcohol that is illegal to sell in this state. Perhaps that's why breweries are quicker to host a bottle share than a location like a bottle shop... A brewery can simply point out the fact that the bottles being consumed are not their own.
Indeed we are! Details to be posted in this forum tonight. Hope to see another great crowd of our fellow BAs from all over the area.
