    Whatever happened to making an effort to actually go get the beer? I know in our day and age, everyone expects everything to be available at their doorstep. Everyone just demands breweries increase their production to meet demand. It's an easy answer from the consumer side, but kinda ignores a whole helluva lot on the production side.

    Whatever happened to things being hard to get, and better because of that? There's a lot to be said for the journey you take to achieve something. Getting to the top of Mount Everest isn't an easy thing, not everyone can do it - not everyone *should* do it.

    I've never had a 3 Floyds beer. I'd love to try one. I am all for trading for one. I think it's a great (and friendly) way to try new things. Ebay is purely mercenary. I don't expect it to go away, but I also don't have to like it. That said, I have no problem with the idea of having to drive to somewhere in their distribution region to try their beer. I imagine I'll try 2 or 3 other amazing beers on the way. Gee, darn. And if I don't get that uber-rare beer that everyone is dying to have? Oh well, I think I'll live. And enjoy myself nonetheless.

    Suck it up, make the trip if you have to have it so bad. Go visit the brewery. Meet the people who make it. Try something else they recommend. Get off your ass and out from behind your computer and live a little.

    Take the journey.

    As far as Alpine goes, I fully support his decision. It's his business, and his beer. He's looking out for his product, his business, and the people he sees everyday. Good on him. Seriously. If you're getting his beer off of BA via trading, or from Ebay - YOU ARE NOT HIS CUSTOMER ANYWAYS.

    Not an awful argument by any stretch. Drinking responsibly with that ABV is one glass of it. That'd be ridiculous, only having it available one pint at a time if you have to drive when you could clearly just fill growlers and have 99.9% of people enjoy them how you envisioned. It's a good thing this guy isn't into like gun manufacturing if he's worried about what happens to it afterward. Once you sell your product it's not yours, and what happens to it isn't your concern, or at least it shouldn't be. This just seems silly to me.

    That could be unconstitutional IMHO. See Heart of Atlanta Motel v. United States, 379 U.S. 241 (1964)

    Any business that wants to roll that way, have fun explaining your attorney and judge when the usual suspect classes claim discrimination.

    Calm down Francis, you're not being treated like a "2nd class" because you can't get a beer in a growler. You can still trade for bottles so relax. It's not the end of the world. Are you just as butthurt over PtY?

    I believe because they're getting at the point that illegal doesn't mean wrong morally or anything like that. Its not relevant though, its illegal and you take part in it at your own risk. Trading is also illegal but we all do it so who cares. Legal or not its not what Pat wants and that's the relevant point.

    Can you show me where a single person has ever been convicted for selling beer on ebay? Or is that (illegal) just like, your opinion man?

    I needn't respect someone that is selling me something for profit and I do what I want with it. I'll respect his wishes if I receive a gift...
    That being said, it is illegal and he should just sell it draft.

    Yes, serious. I'd like to know, is there a single example of ebay being found complicit/guilty in the conviction of participating in illegal sales of beer?

    Everyone likes to say its illegal, but I'm not aware of any actual determination by a court of law . . .

    The fact that it's never prosecuted doesn't make it legal. Levitation cited the law upthread.

    I'm assuming you don't need a 'proper' license based on Alpine's direct sales to Bev4Less. Must be legal, they wouldn't dare be hypocritical.

    Nonetheless, still waiting for someone to show me where a court has convicted someone of all this purported illegality. . .

    Its purely speculative the law is applicable, or enforceable. Until the law is prosecuted, you generally can't challenge it to determine if the law is in fact legal (standing). So whether its legal or not is unknown, but again, I have a feeling that the billion $ + entity probably has better attorneys on the matter than the plebes in the forums that stayed at a Holiday Inn.

    The opinions of illegality (many) far outweigh the non existant convictions in a court of law (apparently zero).

    That law doesn't even mention ebay. . . or collectible bottles. Nor has any AG or DA that I'm aware of even attempted to prosecute based on the alleged applicable administrative regulation.

    sorry i didn't respond to your earlier post addressing this, but i thought you were joking. this is self-distribution, which is permitted in california.

    what i was publicly challenging pat on is that bev4less is known to resell at a high markup and ship to states where it is technically illegal to ship. to me it's identical to ebay. so where is pat with his hand-wringing then?
