    I sympathize with Carr, but sometimes I wish these small breweries (or soda makers) would stop counting on social media to resolve their trademark disputes.

    It is not that hard or expensive to use the trademark system (instead of Twitter or Facebook) to protect your intellectual property before the shit hits the legal fan.

    So this actually leads to an interesting question- since Moosehead apparently hasn't defended its trademark against Big Sky's Moose Drool ("Carr said he's offered concessions like tweaking the logo and even removing "root beer" from the title.

    ) can this be portrayed as diminishing their trademark as is usually claimed?

    Life ain't fair. Come up with a better name and move on. And quit whining on social media. With so many corporations running around these days with deep pockets, you shouldn't be overly surprised by this (as a business owner).

    Some of these trademark disputes are beginning to become rather boring.

    I think I remember way back when.....
    Moosehead did go after Big Sky Moose Drool, but I think more so because of the moose picture. I could very well be mistaken

    Think I am going to start a brewery called Top Hop Experience (T.H.E.) and sue every brewer that has The in their name or beer name. some people need to grow up

    This one seems more sympathetic than the Innovation vs. Bell's deal.
    Every new "deal" seems to be getting worse and worse. One almost needs to find a brewery name that is a MADE UP name and go about it from there.

    yeah with about 4000 breweries in the US alone names of breweries and beers are getting to where they can be pretty close to each other

    That wouldn't surprise me- but it seems that they were willing to reach a settlement at that time. Now they're stampeeding straight for federal courthouse.

    The title is a bit misleading imo. I had to look up who the big guy is in this case.

    I remember Moosehead being pretty popular in the late 90's. Back when Labatt and Molson seemed to be a lot more popular in the US as well.
