so it happened to me.. no options?

    This happened to me once at a UPS store. Got a call about 15 minutes later saying they know I was shipping a liquid and thought it was alcohol. I was allowed, as you should be, to pick up the box. When I got there the box was open and the lady I dropped it off with was yelling at me about the fines THEY would get for taking possession of and shipping the box.

    Franklinn you are right.....this isnt the first time this has happened to me. Glad I called his FedEx contact and she is going to "smooth it over"

    Glad we got that Heady situation figured back then, and glad this will be working out without the need to bust heads or call the cops!

    Sounds like Fedex is intent on violating the law, not you.

    I know destruction of another's property w/o consent is criminal in every jurisdiction I've practiced in.
    I also know that conversion is an available remedy in every jurisdiction I've practiced in.

    Basically, it sounds like you need to tell the guy, its actually he who needs to chose what to do:
    a) give the box back and call it a day (your demand)
    b) destroy the package against your will followed by a call to the police (re: destruction of property)
    c) empty the contents and ship the glass, against your will, to be followed by a small claims conversion lawsuit against both him and fedex.

    Still may need to call the cops. Guess when you send an email with the title DIRECTOR to someone it makes them jump. Let's just see how high.

    I'm confused, from your initial post it appears you dropped it off at a USPS location since you didn't have a Fed Ex location near you and you couldn't ship UPS. Is this correct? If so, then it's an entirely different ball game.

    EDIT: Disregard. Mail box store through me for a loop.

    He dropped it off at at a authorized FedEx shipper but not a FedEx office location.

    just talked to an officer, he said go up there he should give it back to you, if not call the police dept back, hope this works out.

    Watching this thread for a resolution...good luck OP. Sounds like this guy is trying to either score some beer or make out with $550. Sounds to me he needs a boot to the head.

    Just go up there then and demand it back in tact the way you gave it to him. Confirm the condition of the contents before you leave too.

    Fuck this guy. I would go in there, demand my property, and call the police if he won't give it back. That's larceny and destruction of property if he pours it out. If they refuse to ship it, fine, but it's not like you're shipping cocaine or a puppy.

    This twerp is not a police officer, a judge, or even a postmaster general... he can't simply destroy your property.

    It is possible that their ground trucks could be searched at state borders for alcohol. I've heard of people getting busted for this before in personal vehicles with large quantities of beer (IE: crossing state lines to pick up beer and bringing it back).

    I've never heard of that happening to a UPS truck though. But it is legal if there is reasonable cause for search.

    Ha! The federal government violates the Constititution by failing to enforce Article Four, Section IV at the border, ignores the plain language of the privileges & immunities clause in prohibiting such a transport. . . but hey, we will stop US citizens engaged in legitimate commerce!
