I don't see 3 Floyds winning this case. The brands are named Abnormal Beer Co. and 3 Floyds Brewing Co. The packaging is much different. There is no brand confusion over this tag line.

They don't have to win the case. Abnormal just has to settle. They don't have $250k to pay legal fees to fight 3 Floyds.

It has nothing to do with confusion, it has to do with protecting your trademark (including, but not limited to symbols, names and, yes, even slogans) because if it didn't, I'd be on here announcing my new brewery- The King of Beers Brewing (thanks for all the free pub AB!). FFF has branded themselves as not normal, a brewery branding themselves as "abnormal" is pretty damn close if you use a thesaurus.

Using this thesaurus standard, I quickly found a few others which might need to lawyer up soon.

    Uncommon Brewers
    Strange Craft Beer Company
    Aberrant Ales
    Atypical Brewery & Barrelworks

Hell, let's bring this full circle and pit Bell's eccentricity against FFF's not-normalness!

On that note, shouldn’t Drie Fonteinen file suit vs 3 floyds? I really thought that Molten Mirrors was going to convey the same taste and aroma as Gueze vintage.

I think three Floyds (aka three white imperialist men) owe Haiti reparations for their cultural appropriation of zombies.

Seriously, this is a frivolous lawsuit. Shame on them.

This may not help much but I think so because BA Crack the Skye was at FOBAB

If Drie Fonteinen wants to sue over the 3F symbol they could...The problem is I don't think they have ever used 3F as part of their brand. Isn't that an abbreviation created by beer geeks with no trademark?

Last year’s batch had a bottle date of 8/17/17. So it appears to be behind schedule at minimum.

Yes but it was December in 2016 at the time of its first release.

Huh, the 3Floyds website seems to say it was released in September to coincide with national suicide prevention week?

Person 1 - “what beer are you drinking? I really like it. ”
    Person 2 - “it’s Abnormal.”

Person 1, 3 weeks later, seeing this tap handle, orders the beer.

I don’t think it’s out of the realm of possibility if 3 Floyd’s is ever in the same market.

The kind of person that confuses a three word phrase with a single word title that starts with a letter neither of the words in the phrase start with, is the kind of person that isn't ordering craft beer full stop.

What if it’s my mom, who know’s nothing about beer, other than I like it?

This is meant so there’s zero confusion across the entire population. Not just amongst knowledgeable consumers.

    So let’s amend the scenario.

My mom - what beer is that, my son really liked it.
    Person 2 - it’s Abnormal.

My mom 2 weeks later at the liquor store to the clerk - I’m looking for a beer my son liked, oh shoot - I can’t think of the name, something normal? Not normal?

There's so much more to be confused about in the craft beer universe than a short tagline FFF uses in some printed text here and there.

If you tell your mom you want some FFF or she maybe is planning to buy some as a gift, how could she confuse that with anything regarding their tagline? Surely, she'd ask a bottle slinger or shelf stocker "do you guys have any of that Pink Floyd stuff?"

Speaking of, time for Pink Floyd to sue.
