    i mean the claim is that there was an email exchange. that would be so trivially easy to verify that its pretty silly for you to think that no one checked the email thread before cutting a check to the guy

    i dont disagree with your #$%@ him mentality but Im just saying that your theory is pretty wild

    You'd be surprised what people will claim these days. We've had people photoshop together all kinds of stuff and claim we told them this or promised them that. We keep very good records and can prove, when needed, that a customer is full of it. I imagine not all these groups are so organized.

    Occam's Razor is a ridiculous way to make your argument, especially in this case. First, because it typically requires a false constraint--that there are only two possible explanations for something--and second, that one of the possible explanations is blatantly more simple than the other. It makes no allowances for situations where there are multiple possibilities and the relative complexities are similar in nature, or for the fact that when it comes to litigation, usually *none* of the explanations are simple.

    I'd like to think that Eagle Rock performed basic due diligence before handing over the cash, but that's far from a foregone conclusion. We see so many breweries that are small enough that they don't seem to actively retain any kind of legal services to advise them on such matters.

    Maybe the staff member did tell this guy that he couldn't attend. Eagle Rock offered the plaintiff compensation in what would seem to be equal amount to his alleged injury, but unless the guy just agrees that it is enough (which, given his history, it was obvious he doesn't give a shit about the forum, he just wants them to cut a check), the only way to determine that is a jury trial, which is expensive. Hell, Eagle Rock may even have an email thread that proves definitively that their staffer did NOT tell Mr. Frye that he was prohibited from attending, but again, trials are expensive. Even trials where you expect to win.

    If you do a quick google search for "Steve Frye Orange County", you'll see that this is far from his first rodeo, including at least two cases where the defendant refused to settle and won against his claims. One of those claims was against a restaurant, saying he had been denied the ability to purchase drinks/appetizers from the discounted "Ladies' Night" menu. So basically, he was flat out lying in that case.

    These types of lawsuits are utilized by vulture plaintiffs attorneys for ADA claims as well. The laws are very poorly written, IMO. There are several attorney's that utilize plaintiffs that they pay (illegal) or don't even exist (also illegal) in an effort to extort settlements from small businesses. They are definitely not claims that anyone with a brain would consider consistent with the spirit of the law.

    The attorneys that bring these claims, along with their plaintiff's, are the scum of the earth and I wouldn't shed a tear if every last one of them was mowed down by a bus.

    I could type all day about this topic but I'll save it so I don't get overly aggravated.

    By the way "Ladies Nights" at bars are illegal thanks to these laws. And bars have been sued for having them.
