This post reminded me that I need to visit Ope! Brewing again. Well, I made it here and all is great.

I know naming lawsuits occur often enough within the industry. I’ll step out of the way from providing any legal advice. However, Minocqua has developed itself a reputation for creating trouble and having a haughty attitude; even in the article their response to the lawsuit feels nonchalant.

Kirk must really love losing money. It's shocking that MBC hasn't folded up shop yet after all the lawsuits Kirk constantly brings on himself. Hopefully Ope sticks him with all the legal bills, and maybe just maybe (doubt it), he'll learn a lesson about following the law.

If MBC's terrible beer didn't make you dislike them, Kirk being an awful human being should dissuade everybody from giving them money.

“We also ask that you do not post comments attacking or even defending either brewery. ”

Yeah, that’s not going to happen. Shame on anyone that names themselves after common stuff. It’s just dumb. But it’s also dumb that Minocqua is fighting this rather than just being respectful to a small brewery no one has ever heard of and changing the beer name that will become irrelevant in 3 months to 8 years. If it was their schtick of a partisan political fight, okay, but this is just a silly suit.

Look at the names of a ton of breweries and you’ll see common stuff, but I get what you’re saying. But who cares? Name your company whatever you like. It’s unique enough with respect to beer, unless said in response to accidentally knocking over someone’s over.

Minocqua is being disingenuous- they know about trademarks (or at least have some sort of IP legal advice) because they have their own active trademarks see below from a <1 minute search:

They just liked the name and either decided not to search (doubtful) or just tried to sneak this through and rely on public sentiment to shame another small brewery for doing something they need to do to keep their trademark. A bit lazy and shady in my personal opinion.
