Never thought about that; they are very similar, and hearing about how they sometimes ask to be shelved next to Flying Dog is a bit too suspicious.

I don't have much sympathy for anybody who buys that AB-Inbev beer thinking it's a Flying Dog b/c they should've read the label clearly before blind purchasing. That said, the label is clearly a ripoff perhaps intended to confuse the aforementioned blind shoppers.

So AB will sue Dogfish Head under the guise of claiming "Punkin" is too general of a name and can cause customer confusion but then they will also blatantly stoop to these copy cat depths which obviously encourage customer confusion. Big business scum....

It's just business. Like how supermarkets put red and white labels on their own-brand cola.

Well, the distinguishing palate knows to buy neither, so I think no one on BA will be fooled.

You took the words right out of my mouth. If the situation were reversed AB In Bev would be whining like a . . . well, they would be sending letters and threatening suit.

Unethical to copy successful practices from other businesses? You're in for a rude awakening from every business ever.

Are you kidding me? Just because I called it what it is (unethical) doesn't mean I don't realize that it happens all of the time.

I used to think these things were overblown, until I heard a coworker referring to Lagunitas Shandy .. had it confused with Leinekugel's

Some people are going to be confused, and I doubt AB is doing it by accident

If you agree with the report that it's more of a copy of a [pseudo-]"trademark", then it's not a "practice" that's being copied, but a more deliberate attempt to capitalize on another's brand. While likely this case does not extend to the point of being illegal, it is kind of unethical. To argue that it happens often doesn't change that, although the point is well taken that to be in a business you must understand mimicking happens.

All that said, I think not confusing the two takes only a modicum of attention. A little research could easily tell you that they are from different brewers, even if you thought the AB brews were a different line from Flying Dog.

I'm having a hard time figuring out what kind of consumer looks at a cartoon dog and thinks "Shit, that looks like Ralph Steadman's work. Must be Flying Dog." I would be embarrassed as a consumer to even admit I had made that mistake.

Steadman has cool art, FD is nothing to go out of your way for.

Feel bad for them that AB/IN Bev is hurting them but frankly, if their product was better, no one would make the mistake.
