Most identical two labels

    The new Sierra Nevada cosmic ipa label is almost an exact match to a label from sea quake brewery in Crescent City. They are so exact that it seems like the same artist.

    I know if you put an infinite number of monkey at typewriters they'll eventually duplicate a Shakespeare play but apparently it takes fewer monkeys and in less time using a computer drawing program to make the same beer label?

    Spoke with the Original artist that did Seaquakes label and he confirmed they stolr his art.


    again , Fuck sierra Nevada (until they rectify this issue it's fuck them X 10)

    Wow, straight-up plagiarism. But I wouldn’t be surprised if this kind of practice increases as younger generations continue to think anything they see online is fair game.

    Dunno, this is far too coincidental for such a big organization like SN to allow slipping by -- especially since both breweries are in California.

    It's such a brazen, dumb, obvious and potentially costly swipe that I'd be a little surprised if Sierra Nevada knew what was fully going on. We're not talking about the Lagunitas IPA font here. Given that the Space Sailor artist has been commenting about it on SN's social media, and that SeaQuake was tagged about it 2 months ago, one would think that SeaQuake has contacted lawyers already.

    Do a Google Image search for "Astronaut surfing" or use other terminology, and you'll find hundreds of images. Shutterstock has "1,132 surfing astronaut" images, Vector Stock says "Astronaut Surfing Vector Images (over 170)", 100s at Esty, and there are "270 incredible Astronaut Surfing vectors, icons, clipart graphics, and backgrounds" at Vecteezy.

    I'll give you that these two are awfully similar, but good luck with a lawsuit.

    I’m no lawyer, but isn’t the point of these kinds of protections (names, images etc.) at least in part to keep consumers from buying one product when they think they’re buying another? If I put out a beer around the holidays featuring a log cabin surrounded by snow-covered mountains and evergreen trees (even though I’m sure the internet contains numerous images of such a scene), I would fully expect to hear from SN.

    Sure, that's is one factor the courts would consider. They even took it under consideration (along with "trademark dilution") when Anheuser-Busch sued the makers of the dog squeeze toy branded "Buttwiper".

    I mean, how drunk would one have to be to get confused? OTOH, most Petsmart locations' beer selection is lousy:grin: (Yet freshness is still superior to most Total Wine stores).

    As someone who has that seaquake space sailor as a ubiquitous option in every cooler around I could absolutely see mistaking the sierra nevada beer for the sea quake one. The color scheme is nearly identical and could easily be mistaken for a slight label update on the sea quake brand.

    This is a terrible look for sierra nevada

    If anything Sierra Nevada is bringing free advertising and publicity to the other brewery.

    Oh, I can see Sierra Nevada changing their label, and apologizing (depending on the history of their image, trademarks if any, the artist(s) involved, etc.) maybe even throwing some bucks at the other brewery, offering to do a collaboration brew, etc --- but I don't think actual legal action will result, which has often been the final resolution of craft vs. craft brewers when it comes to trademark conflicts.
