It's a good thing I've adopted the practice of reading what I buy before purchasing. It is really something we should all do more of.

Flying Dog has a new beer coming out called The Truth imperial IPA.
This is just more publicity for them.

    regular,
what part of NJ did you take or find that pic?
I would never allow a distributor to dictate to me product placement on my shelves. Of course, I have the beer set up the same way as wine, by style. I know some breweries don't want that, they want all their products together, but I'm trying to educate customers and get them away from being beaten down by broad advertising. Besides, I've never been in the mood to drink a certain brand of beer, but I'm always in the mood to drink a certain style of beer, so that's how I'd want a store to be if I were a customer.
That is shitty of InBev to want to do that. Reminds me of that movie 'Beer Wars', where AB would copycat a beer just to grab as much market share as they could and how they make beer in an overkill of packages (6pk, 8pk, 12pk, 18pk, 24pk, 30pk) just to absorb as much space on the shelves and beerbox windows as they could. Sneaky bastards. The windows of a beerbox are the most valuable real estate in a store (beer wise), so if they make more of their own packages then that's less space for other brands. I say if your product was worth a shit then you wouldn't need so many damned packages to 'trick' consumers into buying it.

that picture was taken from the article, but i do agree. who ever set that up or did the restocking had to be scratching his head a bit....or maybe he just didn't notice and put them up.

Huh? There's no lawsuit or threat of legal action.

Like how they we're bold enough to use raging bitch in the picture but then placed things so you couldn't actually read it.

The people who would be confused by that packaging must be the same people who were confused by the upside-down-in-a-different-color logo that Magic Hat went to court over. We need to assign a BA to help those shoppers.

Thank you I thought the same thing! I find the similarities stop at the fact that both packages contain BEER.

There is no mistaking it once you taste it - unfortunately the consumer can't do that in the store. As far as I know anyway.

How would they discern between the quality of the product at the liquor store? Does your store give out samples?

Wouldn't someone ask themselves "Why would Flying Dog make two beers that are in 6 pack holders that are at least 1/2" to 3/4" shorter in height than their other 6 pack holders!?" But honestly, yeah there is a very, very slight similarity in the artwork as if someone untalented tried to copy the drawing of someone talented, but the packaging isn't really that similar. The IPA and Pale packaging look as if they belong together but the Wild packages don't look like they fit in with the overall design of the other two.

I guess I am approaching it from the idea that they are not that similar and a loyal and devoted customer who is familiar with the product shouldn't find them similar. I acknowledge that loyal and devoted doesn't mean quality--a lot of people are devoted to things that many on this site would not find good. I guess I am looking at it from how I would approach it. I love Lagunitas, I think they have great stuff. If something came out I did not recognize from them or looked similar, I would first look to make sure it was Lagunitas. The strength of the brand is what gets me to try something new from them but I first make sure it actually is Lagunitas. I should have been more clear. Thanks.:sunglasses:

Sorry, but I have no problem admitting that I never realized that these were not Flying Dog releases. And it is not just because there is a dog, but because of the style of the artwork and lettering. Except for the occasional Gonzo purchase, I am not a fan of Flying Dog, so I never stopped to really look at these simply because I thought that these were Flying Dog releases. They appeared moderately different in the packaging, but in my head and only casually glancing at them, I thought that this was a special Flying Dog line, maybe marketed more as a gateway line. So if I can walk right by these releases, because I was confused and presumed that they were a brewery that I rarely care for; then it isn't too far of a stretch that somebody else, who may be looking for Flying Dog beers, would be drawn to these by first presuming that they are from the same brewery.

I am not sure how it works in the art world, but I am surprised that I haven't heard of a lawsuit being brought by Steadman himself about this. His style is very distinct and for somebody to mimic it so closely, dilutes his "brand" of artwork.
