It's still their property and they can say that it wasn't for sale at the time you destroyed it.

You should probably just go for it. You have the moral high ground and all

If that's the case, couldn't I use their instagram posts as evidence that it was intended for sale?
Also, if OH has already alerted authorities, why haven't said authorities done anything about this? It's not like BFFM is attempting to hide this or sell it from behind the counter using a password.

Okay buddy. If you wanna go tear down the store or just destroy those specific beers, just do it. Just be aware that outside of Beer Advocate there are real consequences for such activity, and the cops and justice system could care less about anything you've mentioned.

I don't want to ruin your potential hopes for the NYC justice system, but it might just be that a grocery store illegally reselling a couple of cases of beer for a moderate upcharge is pretty low on their priority list.

Yes, the police I think would find this significantly of higher interest than the original case.

Any lawyers out there want to settle this? Maybe this legal term has some bearing here? http://en.wikipedia.org/wiki/Ex_turpi_causa_non_oritur_actio

Can we take all this (rightful) BFFM bashing back to @JGam115 thread? OH has given their stance on the issue, so no need to derail this thread any further IMO.

Yes, you would be arrested and charged with Destruction of property. Unless you pay for it and posses it, its not yours to destroy.

Are you a lawyer or police officer? Not trying to be a pain, but I just want an honest answer.

I think if you showed the officer your live Instagram feed, it would probably be ok. I doubt an older screenshot of Instagram would cut it though.

Neither, its basic knowledge of law. You can't destroy someone else's stuff and it not be a crime. You can't even destroy your own stuff if ownership is in dispute. IE: Divorce, Estate issues

Yea I'm sure OH would love to have the reputation of being a bunch of thugs. You'll be doing them a real service.

regardless of whether what they did is illegal, what you're doing is illegal too. maybe they won't report you, press charges, or sue you, but the cops can independently arrest you and charge you with destruction of property. i'm not sure "the stuff was illegally obtained" is a defense that'll hold up in any court. not really a legal question -- it's one of common sense.

Is anyone else surprised by the hostile responses I'm getting for presenting a hypothetical? I guess members on this site aren't capable of courteous and constructive discussions.

How do you have a constructive conversation around:

"let's say I decided to go into BFFM and destroy all of the OH products they have in the store"

My, well, yes Aventinus that is a very intellectually stimulating scenario you've illustrated right there

So my lack of knowledge of the law is now considered stupidity?
Maybe my one mistake was inserting myself in the situation. I should have just posed it as a "random person" committing this act. But still, it really was meant as a starting point for a discussion of the legality of the act.
