Well, where does it end? Look at all the beers with the word hop in their name. Could one brewer decide to trademark the word hop and force the rest of them to change their beer names? What about breweries with the word hop? As the craft beer industry grows, there's be gonna be more and more of this. What if a new brewery in Speedway, Indiana opened up, and called themselves Racers Brewing, would BR sue them? I just don't see where the use of one word in a title gives you exclusive use of that word in your industry.

Again, it wasn't just one word, it was the similarities of the label through a combination of things. Bear Republic hasn't sent a cease and desist to any other breweries that use Racer and/or Red in their names.

Over all I agree with you. Getting lawyers involved should be the very last resort.

Both. Of course it's always nice to have really solid beers fresh from the source right in front of you, but when I was going there ('07-'09'ish) the pub-only type drafts were not very interesting, at least to most of us (stuff like black wit, esb's, etc). Ambiance was just weird too. Maybe better outdoors on the patio... it is in a really cool area/town.
