Bad Trader: smitty5245 Please Help

    No one ever said his boss would care but if he even mentioned to the scumbag that a stranger contacted him regarding a possible theft then it may change his opinion. I promise you if my boss told me someone contacted him about me stealing from them a) my boss wouldn't be too thrilled b) I would get my ass in gear and send a box.

    Either way I think he accomplished something, he reminded scum bag that he still owes him a box.

    Theft is theft. If I was the Director of Sales for a growing company, I would want to be sure that my salespeople were honest, upstanding employees. If he is willing to lie about a beer trade, what might he be willing to do to close a sale and put money in his pocket? Sure, this won't likely result in a package of beer on my front porch... but it won't be any less effective than sending repeated (and ignored) messages to him requesting updates...

    The whole "theft is theft" thing is just grasping at straws.

    You have absolutely no legal recourse in the matter.

    What's that old saying?

    Absolutely correct. I have no legal recourse here, but that doesn't mean I'm going to sit around and do nothing. There are things I can do to hopefully show him that his deceptive actions will no go without punishment. I realize that I could have done things differently at first to protect myself. When I initiated the trade, I could have been more cautious, but none of his trade reviews indicated that I would be put through this sort of mess. Now people on this site will know what he is like... and also his boss will be aware.

    It's no different that someone grabbing your camera/phone/purse & running off down the street. Do you shrug & go "Oh well" or run after the bastard yelling, hoping you or someone else can get your stuff back?

    'Trade at your own risk' isn't the same as quietly taking it in the kiester. A thief deserves any possible pressure another trader is willing to put on them.

    This is very different, actually. In this case, it's literally handing someone your camera/phone/purse while simply hoping that they don't run off down the street with it.

    Still not entirely convinced that sending someone's boss a scathing email does anything other than maybe make you look like an unhinged ex-girlfriend.

    Honestly, I wouldn't be terribly surprised if this dude and his boss are kickin' back a few in the old boardroom right now having a good laugh over this. Maybe the boss's boss should get a nice message as well. Who know how high up this actually goes?

    Depends on their relationship...you could certainly be right. But I would think at the very least that it would put some doubt in the back of his boss' mind about him.

    If I got an email about something like this for one of my employees, I'd definitely remember it and think that it was weird or even simply just annoying...and that stigma would always remain...whether or not it results in any sort of repercussion toward the guy is another thing altogether...

    That's wrong, you've made a verbal/written agreement, it's not even close to "handing" someone your stuff. Sure, it involves trust, but every agreement does.

    And who gives a otter's ass what some random thief's boss thinks of you?

    Right, a verbal/written agreement (can't we just call it a contract if we're going to get all legalese about it?) which holds almost no legal significance.

    You did what now? Shipped beer across state lines? With no license, you say? And now you're expecting to have alcohol shipped back to you in return?

    A very strong argument, indeed.

    There are still two indisputable facts that remain:

    1) The OP is at a loss and will likely remain that way at this point
    2) There is no legal recourse regardless of whatever "binding agreement" everyone thinks they're signing into

    If sending angry emails makes you feel better.....go for it. If that's your only source of solace then I guess you should take what you can get, right?

    I never comment on these bad trader threads, but I can't resist anymore...

    No, it's nothing like this, actually. They entered into an agreement to exchange beer, I don't know about you, but I take my word very seriously. It's this type of attitude that is creating problems on this site, as well as many other areas in our culture. When I come to an agreement with someone, even verbally on a BM, it's as good as a hand shake, and NOTHING is breaking that bond.

    Yes it's only beer, but it's also a man's word/honor. I don't care if an agreement on here, or anywhere for that matter, holds no legal significance, I care if you break your word. I wish people would stop trying to take advantage of others, and stop hiding behind the anonymity of a keyboard. There are so many great people on here, it's a shame a minority of scumbags like @smitty5245 dirty it up with their filth.

    And I know you don't care, but I'll be adding @Knifestyles to my DNT list since it's apparent your word means nothing to you. Thanks for coming on here to argue, and show your true colors.

    That's a funny thought right there! Kicking back reading out loud the letter and laughing while drinking the beers he sent.

    But seriously sending the boss a letter is taking it a bit far. If it were me (and I am not able to really trade at this level, mostly with guys at work and fellow local BAs) I would BLOW UP this guys BA and personal inbox non-fucking-stop until he sent the box. I would NEVER spend the kind of money it takes to ship a box of 12 beers and then not get anything in return except excuses and lies. Ya just don't make promises yer ass cannot cash!

    To bring it back around to the original situation. I have repeatedly "blown up" his inbox. It makes absolutely no difference how many messages I send to him on this website if he hasn't been on since July 11th. So, without a personal phone number to call... I reached out to the work info he supplied for shipping. His boss's auto-reply said he would be out of the office on vacation until this past Friday. If I hear anything back this week, I will be sure to update... stay tuned!

    Also, @Knifestyles... what purpose would you possibly have for defending a thief? Seems like you're just trolling, and that has no place in an awesome community like BeerAdvocate!
