Dark Horse Plead the 5th ABV?

    Is Dark Horse Plead the 5th really an ABV 12%+ beer?
    And if so, why was I able to purchase it at a store in Columbus, OH?

    It certainly makes me drunk enough to believe it's 12%... does the Ohio law prohibit beer strictly over 12% or does it also apply to beer at exactly 12%? Plead the Fifth is listed at 12 even, so maybe it's just squeaks under the limit. Or perhaps the ABV changes from year to year, and this release was more like 11.5 or something.

    I'm sure someone else can shed some light on the situation.

    I believe that beer in Ohio can be 12% but not over that. Pt5 does not have the ABV marked on the bottles or the carriers so that is probably how they are able to sell it in Ohio if it is 12+%. Their web site also does not list the ABV. It does not seem like Ohio got any Double Crooked Tree this year when we got it last year. I was told that Double CT has the ABV posted on it this year and it did not have it posted last year.

    When I was in their brewpub last month they had it listed as 14%.

    I thought ABV had to be below 13 in Ohio?

    Ohio has a 12% ABV limit.

    So does the Ohio ABV law go like this?

    11.99% - Totally legal, enjoy!
    12% - May or may not be legal, proceed with caution
    12.01% and above - Kasich will send his goons out to rough you up and pour out your stash
