Never mind, read in the comments. "Bosteels sued Ebly, a brewery that makes a beer served in a yard glass (a glass unable to stand up by itself and has to be resting on a wooden support), like Pauwels Kwak. Bosteels claims they have the copyright to the concept of the yard glass, which they don't. It's apparently a 19th century British invention."
Ah, okay. I was just writing a response to that effect. For those interested, the parties in question: the head brewer Brasserie d'Ebly, Gaëtan Patin, appears to have been sued by the folks at Brouwerij Bosteels (Kwak, Karmeliet, DeuS) for an alleged copyright infringement regarding the type of glass that Kwak is served in:
Apparently Brouwerij Bosteels is suing a new upstart brewery called Brasserie D'Elby over the use of yard glasses. The ones that need wooden supports to stand up right. Bosteels does not own the right to the glass, and De Struise is basically calling them out and asking for people to boycott them in a subtle way.
Haha... I wouldn't call it a "subtle way". Urbain sounds pretty fired up on this one and he has every right to be. Struise was a small start up brewery not long ago. The sturdy brewers standing up for the little man. Go Struise! I haven't had a Kwak, Karmeliet or DeuS in a few years. Actually not a particular fan of there stuff. There are much better Belgian beers the those. That Flagoon glass is a stupid marketing trick anyway. You better believe that I am not buying any of there products anytime soon.
Brasserie D'Elby glass doesn't even look like Brouwerij Bosteels glass. Brasserie D'Elby glass looks like a horn.
You're right, they didn't. I did have to look through the comments to figure things out. Is the suit just to stop using it, or for damages? Does this brewery rely on the glass?
I know Bosteel markets yard glasses to be used with their beer Kwak. Apparently they don't even own the rights to the yard glass, which is 19th century British invention according the the FB comments. My guess it would be for damages considering De Sruise was posting Bosteels profits for the year, and then went on on how Elby is wouldn't even take 0.5% of their profits.
Weather or not they need the glass or weather it is a ceese and disist lawsuit isn't the real issue. It's the semi-big established brewery attacking the little guy for something that isn't there property in the first place. It's a scum bag move.
I agree with this sentiment - it's a dick move. I also read the Struise posts on Facebook, although I recall hearing about the lawsuit some time back. Time to support the little guy....
