This has happened many times when a bottle is broken in transit, and instead of UPS/FEDEX throwing the whole package out, or returning to sender, the person who finds it is kind enough to repackage and send it on its way. Minus the broken bottle.

You brought up a good point and I never considered that a possibility. It's easy to crap on these delivery drivers when you don't really know what happened to the beer. However, the three shipper in the larger box was his and there wasn't any spilled beer on the shipper nor any stench of spilled beer. But, maybe I shouldn't only think of the negative option in this type of situation.

Good on you man. You certainly don't have to but it's REALLY nice that you are doing it. Good karma will come back your way I'm sure.

Would love to hear of anyone who was prosecuted on this type of thing, and especially anyone who was prosecuted due to posting on here. People seem to get way too concerned about potential legal issues from shipping beer. I have never heard of it happening (and if it has happened to anyone, please let us know). Most are concerned about USPS but I have had leaking packages delivered both ways with them and when a bottle broke with FedEx they just returned to me. Anyone have any actual legal trouble, please let us all know.

I've had friends who had bottles break and/or packages seized by FedEx and received serious-looking letters telling them that shipping alcohol is a violation of their TOS and not to do it again, but that's as far as it's ever gotten. It doesn't even seem like they ended up in a database of people potentially shipping alcohol, as they've all continued to ship through FedEx without issue!

@dson08 I remember you telling me yesterday about a box you received that looked to have been ripped open with stuff missing. Is this you?

I'm assuming that if Fedex broke 2 out of 10 bottles, put the remaining bottles in a new box and delivered it without mentioning anything to me I have no recourse? Since it was not, in fact, "olive oil?"

Correct, and you should feel kind of happy that you got the other 8. Their other options are to take the whole thing or return to sender.

In case folks are interested in further developments on this, here's what happened: I never went to FedEx to complain about this. It seems, most likely, that the box was ripped open while sitting in his building's mail room over the long weekend. His building reviewed the security tapes, but the box was out of view, so it was inconclusive. They said we could involve the police if we wanted to push things further, but we decided not to. I sent him another bottle of WoL, and he picked it up at his local FedEx depot instead of having it delivered to his building, to be safe. He then sent me a thank you box with some nice goodies including Zombie Dust and Jackie O's Bourbon Barrel Black Maple. All in all, this ended about as well as it could.
