DLD tics at brewpub?

    Regarding Second Market Dark Lord Sales
    -Dark Lord Day has become the success that it is due to the support from the craft beer community. Each year we’ve worked hard for months to improve the experience of the attendees. Dark Lord Day is the only day that Dark Lord is sold. Part of only selling beer at the brewery guarantees that it goes to the consumer at a reasonable cost and that everyone has an equal opportunity to purchase Dark Lord. We do not condone black market sales of Dark Lord, DLD tickets or any other beer that is purchased at our facility. The best way to ensure that black market sales do not happen is for consumers to not patronize the illegal sellers, (this also goes for retailers who engage in price gouging.) There unfortunately is not a practical, legal or cost effective way for us to police after market sales of our limited products or tickets. We have reviewed many options but have found that all of them would affect our mission of making the best beer we possibly can at a reasonable price to the consumer. If you find Dark Lord for sale on a day other than Dark Lord Day and other than at the brewery please understand that without exception, the sale is not legitimate. It is on all of us as a community to try to prevent black market sales. Thank you for your continued support. We look forward to planning an awesome Dark Lord Day 2013.

    If they do IP sales like last year there is no way to resell them, 1 ticket per person, name on ticket. With the online tickets you buy two, so you can sell the second one as long as you enter at the same time as the purchaser.

    You mean where they wrote peoples name on a glossy ticket with a sharpie marker and it could be rubbed off with water and any name written on it?

    3 Floyds can say anything they want about it but they could shut it down completely. All that has to be done is print a SPECIFIC NAME on the guest ticket. Non transferrable, no exceptions. Problem solved.

    By allowing a generic "guest" of course people are going to sell them. Its not illegal and there is nothing that can be done about it once someone buys and owns the tickets.

    There's not ture, due to the wording on the ticket itself.

    The tickets claim to be a "license to attend the event" (paraphrasing; don't have the ticket in front of me). Conceptually, that means that any breach of terms of the license (viz., reselling of tickets) is legal grounds for revocation of the license without refund (translation: FFF can take your tickets). Per the wording on the tickets, they aren't actually yours.

    I'm not sure if any of that is legally enforceable or if it's just an attempt to undermine first sale doctrine. Media companies tried to argue for a license model for movies, music, and video games to no avail. Technically, though, you sign a contract to supporting the Crowdsurge/FFF view of things when purchasing tickets... so who knows how it would actually shake out if they tried to enforce that clause.

    In practical terms, the event can cancel the tickets (or refuse entry) based on that language and you really don't have any recourse. You can sue them after the fact, and you may win; but, that's a lot of time, you're risking a lot of money. It'd be kind of a moot point, since it likely wouldn't see a judge before the event (so you'd miss DLD anyhow), and suing them would likely get you banned from future events (they don't have to sell you a ticket).

    Good to know. It does suck that people do this but there is a legitimate market for it and people are happy to pay (up to a certain point).

    Who am I kidding? If i wasn't still lazily laying in bed and at the brewpub right now, I would probably buy one. There's something in the water here that makes you want to shell out ridiculous amounts of money for terrible or subpar beer from FFF.
