eBay and Beer Sales

    Trading a limited, highly sought after beer $4$ is completely reasonable. Trading a limited, highly sought after beer your random locals that equal the dollar mount is less reasonable. Trading a limited, highly sought after beer for a limited, highly sought after beer of similar cost is will happen all day long.

    We can make any argument we want if we oversimplify things enough.

    How so? Seems pretty lock-step with it.

    All ebay ever did was allow people to sell beer bottles/collectibles. People flaunted the restriction by saying the "value was in the bottle, not its contents". What they allowed and what they enforced and/or are now enforcing are two different things.

    Beatification B5 - 12,000 bottles - highly sought after - $15 - brewery only

    1for1? Is that going on in the trade forum?

    How about Rare for Ann 1for1? Rare is what - 2 - 3 times the cost , highly sought after and has a very solid reputation spanning 2 years. 1for1 get that done?

    I just want the "trading isn't the same as eBay" BS to stop.

    Do what you want with your beer.

    The brewer is not missing out on secondary cash from either equation. There is not more money being made by their product in either scenario.

    It's the same vein as some broker selling a ticket on stubhub. But, being that most beer and alcohol related laws are so antiquated, there are massive grey areas all over the place.

    On a similar note, do the same thoughts in this thread apply to ebay/craig's list/secondary market sales of beer festival tickets? Yesterday, MN's Autumn Brew Review (ABR) tickets went on sale at noon and sold out in 5 minutes. Literally 20 minutes later there were posts on MN Craig's list selling tickets for $150 a piece (retail was $40). Discuss with or without name calling...

    Then they fufill a need. Not everyone can be there online ready to turboclick. I have used Stubhub before to buy otherwise sold out tickets for concerts I didn't even know were coming soon that sold out a month prior. Glad I had the option.

    Its still legal to sell and transport full bottles of beer across state lines via ebay right? We can agree that it happens every day right?

    If you can't make sense of that, forget about ebay. Ever order from Cascade, Pelican or even another site like Lets Pour?

    The prisons and jails are overcrowded. This just isn't a priority for law enforcement at this time.

    The question of legality seems like the other important issue here.

    Does anyone actually think the shipment of alcohol on a limited basis should be illegal? If so, why?

    And if so, under what circumstances?

    This matters because there's a lot of "well it's illegal!" arguments going on out there. So under what circumstances should it err be legal to ship alcohol? Should the type of alcohol matter? The quantity?

    If I can legally purchase wine at auction currently, should that be made illegal, too, if I don't want beer sold on eBay? If that's ok, what's the difference?

    I suspect that most of the arguments out there on this topic have much more to do with each individual's personal circumstance than anything to do with what makes the most sense for our society at large. But maybe I'm wrong.

    To my knowledge, it is not legal to ship or transport any alcoholic beverage over state lines (depending on the state?) unless you are an entity (i.e. business) that has paid the necessary taxes to do so.

    Yes. Yes I have. Presumably Let's Pour and other online retailers have acquired the proper licenses and permits paid the necessary fees and taxes to ship me said beverages. I don't know if they have or have not, and the onus is not on me to chase them down and ask them.

    I'm not saying it is or should be.

    *someone* out there complained to ebay. I don't know who did, and am not blaming the breweries mentioned in this thread.

    Ebay's policy was never to allow people to buy and sell craft beer on their site - even if they just got around to enforcing it now.
