I can't tell you how many times I've walked into Migration only to be confounded by the lack of elliptical machines. To your question breezy, it's probably just that many of these small breweries don't have to money to spend on this kind of bullshit. I'm sure it's far less expensive to change a logo/label than to hire lawyers, pay court costs, etc.
Personally, I'd change it, then send Multnomah Athletic Club a letter telling them the logo sucks so they can have it.
A cease and desist letter (unless sent by a court) is nothing but a threat (lawyers included)...especially when it's one small company trying to protect their brand. Why are they so nervous that they'd really be taken to court over such nonsense? Any lawyer worth a shit knows that they have no basis. They're not losing business or confusing customers from a brewery logo. That's ludicrous. More importantly, they need to focus on producing better beer and less on their logo and marketing efforts. It's almost like they set this up as a PR stunt or something to gain attention. And then don't get me started about the stupid Burnside situation with the offensive religious claims over a dumb beer. Yet another brewery that should focus on the quality of their product.
This is true. They probably could have thrown the letter in the trash and nobody besides the athletic club would have ever known the difference.
