Pepsi Co sues tiny welsh brewery and wins.

    Probably not fear so much as protection and cost savings. Don't know about the UK, but in the US if you don't aggressively protect your trademark from infringement you lose the rights to its unique use and it can go into widespread use by anybody. Its an odds on bet that its less expensive for Pepsico to take this kind of legal action than to have to deal with re-branding their beverage line as any prior investment goes down the tube as well. From the fact they took this action I'd guess that trademark loss can be a problem in the UK as well.

    It's called bullying. Shitting all over a small company just because their catchphrase is vaguely similar (in that it uses the same generic word) to the name of a company Pepsi own.

    These legal and marketing teams are made up of ambitious, educated, people who are trying to show that they are worth their paycheck. Their job is to protect the brand and the interests of the shareholders. This victory will look very nice on their yearly review and they will probably get a bigger bonus because of it.

    Not saying it's an ideal situation, just some perspective.

    Cheer up! Humanity has survived such things (and worse) for years. "Bleak House" by Dickens was based in part on an existing legal system in place over 150 years ago.

    Absolutely correct Essex. It is called bullying. It is bullshit. But that's life. And it makes you understand why the likes of BrewDog behave like they do in order to survive and thrive.
