Yeah just came here to post that. I've never had a problem with that strategy before but apparently it's illegal, at least according to TABC's twitter.

Hay Merchant allows you to normally but 1 bottle to go, if you want to buy a 2nd, it must be consumed onsite. AFAIK, they have never stated that "you must drink one on site, in order to take one home"

I was thinking of a very specific bar that had the exact opposite rules - you had to drink one on site to be able to take one home.

Same thing happened to me, but I didn't think it was bad since they are a bar and make money from people drinking beers there. Most places in Austin that even let you buy one to go were doing 1/person, so getting to drink one and take one home seemed great. I think the rules are (or should be) slightly different for bars vs stores.

Also, Sam @East1stgrocery with a great response as always...please forgive him @lbour !

I don't mind the policy. They only make money off bar bills and don't gouge for their bottles. I had already had my fill at Bangers and was just walking by. I wasn't their target audience at the time (nor should I have been). I do think it's different than bottle shop or store doing that.

Grabbed a bottle today in Austin/Round Rock... A few HEB's are getting it Monday. It's still trickling in...

Had a great conversation with Sam today. As we all know, a real stand-up guy. No harm; no foul. Glad I stopped in today... and thank you for your thoughtful gesture.
